Terms & Conditions

These Terms and Conditions govern the sale of products through www.welshshepherdspirits.com ("our website"). By placing an order with us, agree to be bound by these Terms. Please read them carefully before ordering. 

About Us

Welsh Shepherd Spirits Limited is a small-batch spirits producer based in Mid Wales.

 

Throughout these Terms, "we", "us" or "our" refer to Welsh Shepherd Spirits Limited. "You" or "your" refer to the customer placing an order.

1. Age Restriction

Our products contain alcohol and are only available for purchase by persons aged 18 years or over.

By placing an order, you confirm that:

  • You are at least 18 years of age.

We operate a Challenge 25 policy. 

We reserve the right to request proof of age, including a valid passport, photo card driving licence, or other accepted identification, at the point of delivery. 

If satisfactory proof of age cannot be provided, or the recipient appears under to be under 25, we reserve the right to refuse delivery and goods will be returned to us.

We also reserve the right to refuse or cancel any order where we reasonably believe:

  • the purchaser is under 18;

  • the purchase is intended for someone under 18;

  • the order is for resale without our agreement; or 

  • completing the sale would breach any legal obligation.

2. Products and Pricing

We take reasonable care to ensure that product descriptions, images and prices displayed on our website are accurate.

As our spirits are produced in small batches, slight variations in appearance may occur. 

  • All prices are shown in pounds sterling (GBP).

  • VAT is included where applicable, unless otherwise stated.

  • Delivery charges are additional and displayed separately during checkout (see Section 5).

  • We reserve the right to change prices at any time, but changes will not affect orders already confirmed. 

  • If a product becomes unavailable after an order has been places, we will notify you promptly to offer either an alternative or a full refund.

3. Placing an Order

Orders are place through our website. 

Once you submit an order, you will receive an acknowledgement email confirming receipt of your order. This confirms we have received your order but does not mean that your order has been accepted. 

A legally binding contract is formed only when we send you confirmation that your order has been dispatched, or once payment has been processed, whichever we specify at checkout.

We reserve the right to refuse or cancel any order where:

  • age verification cannot be completed:

  • payment cannot be authorised;

  • products are unavailable;

  • there has been a genuine pricing or product description error; or

  • we reasonably suspect fraudulent activity.

4. Payment

Payment is processed securely at the time of ordering through our third-party payment provider.

We do not store your full payment card details.

5. Delivery

We currently offer:

  • Free delivery within a 5-mile radius of our distillery. 

  • Delivery outside this area at the rates shown during checkout.

 

Orders are dispatched using Royal Mail, DPD or APC Overnight (or other suitable courier where necessary).​

As alcohol is an age-restricted product:

  • age verification may be carried out before dispatch;

  • someone aged 18 or over must be available to sign for and accept delivery; and 

  • our delivery partners may request proof of age upon delivery.

If satisfactory identification cannot be provided where requested, delivery may be refused. 

Estimated delivery times are provided at checkout. They are provided as a guidance only. We make every reasonable effort to meet these, delivery times are not guaranteed and may be affected by delays outside our control.

Ownership of the goods transfers to you once the order has been delivered and signed for. Responsibility for the goods passes to you upon successful delivery. 

6. Your Right to Cancel

Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have the right to cancel your order within 14 days of receiving your goods.

To cancel your order, please email: info@welshshepherdspirits.com within the 14 day period.

Returned goods must:

  • be unopened;

  • remain unused;

  • retain any security seals;

  • be returned in their original packaging.

Unless the goods are faulty or supplied incorrectly, return postage costs are your own responsibility. 

Refunds will be processed within 14 days of receiving the returned goods using your original payment method.

Please note: because our products are sealed alcoholic beverages, we are unable to accept returns of bottles where the seal has been broken, unless the product is faulty or not as described.

7. Faulty or Damaged Goods

If your goods arrive damaged, faulty or not as described, please contact us as soon as reasonably possible at:

Where possible, please include photographs of the issue. 

We will arrange an appropriate remedy, which may include:

  • replacement;

  • repair (where appropriate); or

  • a full refund,

in accordance with your statutory rights under the Consumer Rights Act 2015.

Reasonable return postage costs for faulty goods will also be reimbursed.

8. Responsible Drinking

Welsh Shepherd Spirits Limited supports the responsible consumption of alcohol.

Please enjoy our products responsibly.

We do not knowingly market or sell our products to individuals under 18, and we do not condone excessive or irresponsible consumption of alcohol.

9. Our Liability

Nothing in these Terms excludes or limits any liability that cannot legally be excluded or limited, including liability for:

  • death or personal injury caused by negligence;

  • fraud or fraudulent misrepresentation; or

  • your statutory consumer rights.

 

Subject to the above, we shall not be liable for any indirect or consequential loss arising from your purchase or use of our products or website.

10. Charitable Giving Scheme

Where you choose to participate in our "Back Your Cause" scheme, a portion of your order value will be donated to charity of your choice, as set out on our website.

Participation is entirely optional and does not affect your statutory consumer rights.

We aim to respond to all complaints within 5 working days.

12. Governing Law

These Terms and Conditions are governed by the laws of England and Wales. 

Any disputes arising from these Terms shall be subject to the jurisdiction of the courts of England and Wales. 

13. Changes to These Terms

We may update these Terms from time to time. The version in force when you place your order will apply to that purchase.

The latest version will always be available on our website.
